2. PURPOSES OF DATA PROCESSING

The processing concerns the following categories of data:

 

• surname, first name, date of birth, academic title, nationality

• gender, religion, marital status, children and other family members, place of birth, former surnames

• contact data (e.g. telephone, email, address)

• photo identification

• correspondence

• social insurance number, social insurance carrier

• data on the establishment, administration and settlement of the business relationship

• sensitive data may also be collected in connection with legal services

 

The provision of the data is voluntary, but we cannot fulfil our order or not completely,

3. TRANSMISSION OF PERSONAL DATA

To the extent necessary for our purpose, we disclose your personal data:

 

IT service providers used by us administrative authorities, courts and public corporations, other recipients designated by the client, other recipients necessary for the fulfilment of the mandate.

 

Furthermore, we inform you that within the framework of our legal representation and support, you will also regularly receive factual case-related information from third parties.

 

Some of the above recipients may be outside of Austria or may process the data outside of Austria. If the level of data protection in the other country does not correspond to the Austrian level of protection, we take measures to ensure adequate protection.

4. THE LEGAL BASIS OF THE PROCESSING

If you are an interested party or a potential future client, we will only process your cotact data via e-mail or telephone contact with your consent in accordance with Art 6 Paragraph 1 lit a DSG- VO.

 

If you are our client, we process your data because the processing is necessary to fulfil our contractual obligations according to Art 6 Paragraph 1 lit b DSG-VO.

5. DATA SECURITY

Data protection is ensured by appropriate technical and organisational measures:

• Access control: protection against unauthorised access to data processing systems

• Access control: protection against unauthorized system use

• Access control: No unauthorized reading, copying, modification or removal within the systems
   

Data leaks have to be reported immediately to the competent supervisory authority and the person concerned.

 

Please note that we assume no liability whatsoever for the disclosure of information due to errors in data transmission and/or unauthorized access by third parties not caused by us (e.g. hacking of email accounts or telephone, interception of faxes).

6. SERVER-LOG-FILES

​

In order to optimize our website in terms of system performance, user-friendliness and provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This  includes  your  Internet  protocol  address  (IP  address),  browser  and  language  setting, operating system, referrer URL, your Internet service provider and date/time.

 

These data are not combined with personal data sources. We reserve the right to check these data subsequently if we become aware of concrete indications of an illegal use.

7. TERMINATION OF MANDATE

Generally, the personal data will be stored until the end of the business relationship and retained until the expiry of the statutory retention and statute of limitations periods. In the event of any legal disputes in which the data is required as evidence, the data will only be deleted after the end of the legal dispute.

8. RIGHTS IN CONNECTION WITH PERSONAL DATA

 

Law Offices Dr. F. Schwank undertakes to keep the processed data secret and to protect the data from unauthorised processing.

 

Law Offices Dr. F. Schwank is responsible for ensuring that the data processed are factually correct and up to date.

 

The client has the right to inform himself at any time about his/her personal data stored, their origin and the purpose of the processing.

 

At any time the client also has the right to object at any time to the processing of data, the deletion of incorrectly or inadmissibly processed data, as well as to demand their blocking or correction. The client may also request the restriction of data processing.

 

The processing of your personal data can be revoked at any time, whereby a revocation does not affect the legality of the processing that took place before the revocation.
